ORDINANCE NO. 2025-07B

AN ORDINANCE TO AMEND AND REENACT SECTIONS 10-4003 and ADD SECTIONS
10-4004 thru 10-4011, PARADE REGULATIONS

BE IT ORDAINED by the Mayor and Board of Aldermen of the City of Jeanerette, in regular session assembled,

That the Code of Ordinance of the City of Jeanerette, SECTION 10-4003 is hereby AMENDED and REENACTED to read as follows, to wit:

BE IT THEREFORE ORDAINED, by the Board of Aldermen, City of Jeanerette, State of Louisiana, that items (1) & (2m) (4) (5) (7l) be amended, as shown in italic, and item (g 5) , (h1A) (7m) and Section 10-4004 Definitions, 10-4005 Parade Designated Rout, Section 10-4006 Failure to start on time, Section 4007 Drivers, Section 10-4008 Riders, Section 4009Age of Parade Participants, Section 10-4009 Floats, Section 10-4011 Prohibited Parkings Along Parade Routes is hereby be added and the ordinance now read

Application requirements. A person seeking issuance of a parade permit shall file an application with the chief of police on forms provided by that officer.
(1)An application for a parade permit shall be filed with the chief of police not less than ten (10) days nor more than thirty (60) days before the date on which it is proposed to conduct the parade. The organization and/or Chairperson shall execute an Intergovernmental Agreement with the City of Jeanerette (60) days prior to the application submittal with the Chief of Police. A signed intergovernmental agreement shall not constitute a permit issued by the Chief of Police.
(2) m. Any additional information which the chief of police shall find reasonably necessary to a fair determination as to whether a permit should issue including the reviewing the security plans and requirements.
(3) The chief of police, where good cause is shown therefor, shall have the authority to consider any application hereunder which is filed less than ten (10) days before the date the parade is proposed to be conducted.
(4). There shall be paid at the time of filing the application for a parade permit a fee: Below Fee Chart.

(5) The applicant for a permit under this section shall execute an indemnity and hold harmless agreement and file with the application a certificate of comprehensive public liability insurance in the applicant’s name naming the City of Jeanerette as an additional insured in an amount of one million dollars ($1,000,000.00) per occurrence for personal injury and property damage to protect the public.
(g)(5): Each Member of the Board of Aldermen
Required information on permits. Each parade permit shall state the following information:
(h) (1)Starting time;
h1(A): MARDI GRAS PARADE start time shall be 12:00 PM unless directed a different time by the Chief of Police. Line-up at the assembly area shall be (2) hours prior, unless directed a different time by the Chief of Police.
CHRISTMAS PARADE start time shall be 3:00 PM unless directed a different time by the Chief of Police. Line -up at the assembly area shall be (2) hours prior, unless directed a different time by the Chief of Police.
BREAST CANCER AWARENESS PARADE start time shall be 2:00 PM unless directed a different time by the Chief of Police. Line-up at the assembly area shall be (2) hours prior, unless directed a different time by the Chief of Police.
JEANERETTE HIGH SCHOOL HOMECOMING PARADE start time shall be 5:00 PM unless directed a different time by the Chief of Police. Line-up at the assembly area shall be (2) hours prior, unless directed a different time by the Chief of Police.
ALL OTHER PARADES start time will be approved by the Chief of Police
(7)(l) Rescinding Issued Permits. The Chief of police shall have the authority to rescind any permits issued by his/her office, due to acts of nature, at any time there is an unsafe occurrence of violence within the City of Jeanerette or the belief of an unsafe occurrence or a threat to the public safety will occur. (This section shall not interfere with the authority of the mayor during the use of Emergency Powers or the declaring of a State of Emergency by the Mayor, Parish President, Governor.)

Penalty for violation. Whoever violates this section shall upon conviction be punished as provided in section 1-1008.

That the Code of Ordinance of the City of Jeanerette, SECTION 10-4004 DEFINITIONS IS hereby ADDED to read as follows, to wit:

Sec. 10-4004. – Definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Carnival/ Mardi Gras organization means a nonprofit corporation, profit organization, association of persons or liked minded person, social clubs organized under the laws of the state for the sole purpose of creating, staging and presenting carnival parades, truck parades or marching club parades.

Carnival/ Mardi Gras parade means a parade staged during the carnival parade season conducted by a non-profit corporation, profit organization, association of persons or liked minded person, social clubs’ organization consisting of floats, Mini floats, and marching organizations.

Elements in a parade shall mean any marching band, military band, dance club, walking club, riding club, or dance troupe in a carnival/ Mardi Gras float parade larger than a group of 10 persons, not including chaperones, helpers, support vehicles, and public safety vehicles.

Fire watch means privately paid uniformed Jeanerette Fire Department personnel subject to the fire official's orders at all times when so employed. The term "fire watch personnel" shall be synonymous with "fire watch", "standby personnel", "standby firefighter" or similar term.

Float means vehicles with platforms used to carry maskers. Floats shall be not less than 23 feet long, nor less than nine feet wide, and not more than 17 feet ten inches high, exclusive of animation which shall not exceed 17 feet ten inches in its lowest position and 20 feet in its highest position, measured from the street level.

Marching band means a group of musicians that marches together while playing instruments and is officially sanctioned by a middle, junior, or high school, a college or university, or a youth-focused non-profit organization that is composed of no fewer than 30 participants. A marching band also means an officially sanctioned military marching band regardless of the number of participants.

Marching club parade means a parade staged during carnival parade season conducted by a nonprofit carnival organization which consists entirely of marching participants and specifically does not contain floats or mini floats.

Mini float means a vehicle less than 23 feet long which may or may not have a platform used to carry maskers.

Night parade means any parade beginning at 5:00 p.m. or later.

Parade property truck means a truck provided by the float builder containing tools and other equipment needed for float maintenance.

Pendency of a parade means the immediate (24) hours before a parade leaves its starting point.

Pull unit means a single tractor or mule pulling a float or tandem float during a carnival parade.

Tandem float means two or more floats, not more than 215 feet in length, attached to one another and pulled by a single tractor or other vehicle.

Truck parade means a parade which consists entirely of self-propelled decorated trucks.

That the Code of Ordinance of the City of Jeanerette, SECTION 10-4005 PARADE DESIGNATED ROUTE, SECTION 10-4006 FAILURE TO START ON TIME, SECTION 10-4007 DRIVERS, SECTION 10-4008 RIDERS, SECTION 10-4009 AGE OF PARADE PARTICIPANTS, SECTION 10-4009 FLOATS, SECTION 10-4011 PROHIBITED PARKINGS ALONG PARADE ROUTES IS hereby ADDED to read as follows, to wit:

Sec. 10-4005 Parade Designated Route
(a) Parade permits issued under this chapter shall be for the same position, route as the parade permit issued by the Chief of Police. The Chief of Police shall utilize the designated Parade route approved by the Board of Alderman that has been designated as the preferred route to be followed by all permittees issued a parade permit by the Chief of Police.
(b) The designated parade route for the City of Jeanerette will be Main Street corridor starting from Main Street at the Iberia/ St. Mary Parish Line to Main Street ending at the end of the corporate limits on Main Street at Burleigh Park.
(c) Penalty for violation. Whoever violates this section shall, upon conviction, be punished as provided in section 1-1008.
Sec. 10-4006 Failure to Start on Time.
The failure of any parade is participant permitted into a parade and/or organization, Chairperson, Social Club, Association, to start at the permitted time of a parade shall subject the said and/or parading organization to a violation punishable as provided in section 1-1008.

Sec. 10-4007 Drivers
All drivers of vehicles and float operators or other prime movers shall possess a current, valid class (E) driver’s license issued by the state department of public safety. It shall be unlawful for any person to do so without a current and valid Class (E) license.

Sec. 10-4008 Riders
No person shall ride on the exterior of an automobile during a parade, except that one person may ride on the back of a convertible automobile that is insured.

Sec. 10-4009 Age of parade participants
(a) The minimum age of persons participating in any parade made up of floats and/or vehicles, whether as riders of floats or members of bands or marching units, or otherwise, shall be (5) years of age. This restriction shall not apply to pages, attendants, grand marshals, or special guest riding floats or vehicles therein.
Sec. 10-4010 Floats
(a) Float Sizes shall be as follows:
(1) A regular Krewe float shall not be less than twenty-three (23) feet in length, no more than twelve (12) feet in width and no more than seventeen (17) feet, six (6) inches in height from the street level, and must have a minimum of ten (10) riders in costume.
(2) A mini float shall be any float that is smaller than a regular krewe float.
(3) A tandem krewe float is considered to be two (2) krewe floats, and shall be two (2) floats joined together, no more than ninety (90) feet long, no more than twelve (12) feet wide and no more than seventeen (17) feet six (6) inches in height from the street level.
(4) All decorations and attachments on each float shall be securely fastened with no sharp, pointed, or cornered objects on the exterior.
Sec. 10-4011 Prohibited Parking Along Parade Route
(a) It shall be unlawful for any person or entity to park, store, leave standing or permit parking, storing, stopping or standing of any vehicle on any private property within two hundred fifty (250) feet of a parade route, without proper authorization of the owner, lease, person in control of the private property or their agent, where signs have been posted declaring that parking is prohibited or is otherwise reserved for authorized vehicles only.
(b) It shall be unlawful for any person or entity to park, cause to be parked, any vehicle overnight on public property or private property during alone the parade route without proper authorization of the owner, lessee, person in control of the property, or their agent, where signs have been posted declaring that parking is prohibited or is otherwise reserved for authorized vehicles only.
(c) Any person violating the provisions of this section or sections pertaining to parking alone the parade route shall be guilty of a misdemeanor and subject to a fine of five hundred dollars ($500.00). Each day any violation of any provision of this section or sections shall continue and constitute a separate offense.

BE IT FURTHER ORDAINED, that all ordinances and resolutions in conflict herewith are hereby repealed.

This Ordinance shall take effect and be in force 10 days after its adoption.

This Ordinance was introduced on the 21th day of July 2025 by Alderman Duplechain and second by Alderwoman Moore notice of public hearing having been posted on July 22nd, 2025, said public hearing having been held on August 11, 2025 the title having been read and the ordinance considered, on motion of Alderwoman Moore whom moved its adoption, seconded by Alderwoman Clay, and upon roll call was adopted by its title, section by section, and as a whole, by the following yeas and nay vote:

This Ordinance was thereupon declared adopted by Mayor and was approved and signed by him and attested by the City Clerk and the corporate seal of the City of Jeanerette affixed hereto on this 12th day of August, 2025.
