RESOLUTION 13 OF 2024
RESOLUTION SUPPORTING THE APPLICATION TO ESTABLISH THE RAILROAD AVENUE HISTORIC CULTURAL DISTRICT IN JEANERETTE, LOUISIANA
WHEREAS, Act 298 of the 2007 Regular Session of the Louisiana Legislature authorizes Local Governing Authorities to create Cultural Districts as a mechanism for community revitalization through cultural activity hubs; and
WHEREAS, the Louisiana Department of Culture, Recreation and Tourism, Office of Cultural Development, is authorized to develop criteria for cultural districts and determine if a proposed Cultural District meets those criteria; and
WHEREAS, the Louisiana Department of Culture, Recreation and Tourism, Office of Cultural Development, has established administrative rules for Local Governing Authorities to submit applications to designate and certify a specified geographic area as a Cultural District; and
WHEREAS, the geographic area within the City of Jeanerette, Parish of Iberia, may meet the criteria for the creation of the Railroad Avenue Cultural District, generally encompassing the area within the boundaries starting at the intersection of Pellerin Street and Martin Luther King Drive, Pellerin (N), along Annie More Drive [Railroad Avenue], intersecting at Hebert Street and Martin Luther King Drive, and including all areas from Martin Luther King Drive to Pellerin; and
WHEREAS, the cultural district program allows local governments to designate a cultural district to revitalize communities by creating hubs of cultural activity, provides corporate franchise tax credits for eligible expenses for rehabilitating historic structures, exempts sales and use taxes on proceeds from the sale of original works of art within the district, and requires annual impact reports to the Department of Culture, Recreation and Tourism, which then submits a biennial report to the legislature; and
WHEREAS, only a Local Governing Authority is authorized to submit an application for the designation and certification of a Cultural District; and
WHEREAS, a "Local Governing Authority" is defined by LAC 25:I§1101 as the governing authority of the parish or municipality in which the Cultural District is located; and
WHEREAS, the Railroad Avenue Cultural District is located entirely within the municipality of Jeanerette in the Parish of Iberia, making the Local Governing Authority of Jeanerette the proper entity to submit the application.
NOW, THEREFORE, BE IT RESOLVED that the Local Governing Authority of Jeanerette does hereby:
1. Support and endorse the submission of an application to the Louisiana Department of Culture, Recreation and Tourism, Office of Cultural Development, to designate the Railroad Avenue Cultural District as a state-certified Cultural District by District 12 Iberia Parish Councilwoman, Lady Brown.
2. Delegate its authority to submit the application and all supporting documents, reports, and other forms required for the creation, administration, and reporting to BeeThe1ToHelpSomeone/Sock It (designated non-profit organization).
3. Direct all city employees to support and cooperate in compiling the necessary information and data required for the application and subsequent reporting for the administration of the Cultural District.
4. Request all affected citizens and businesses to support and promote activities consistent with the purposes of the Cultural District.
5. Authorize the Mayor to sign any and all documents required for the creation and administration of the Railroad Avenue Cultural District.
BE IT FINALLY RESOLVED, that this Resolution shall the creation of the Cultural District. This Resolution having been, carried with a vote of all Yeah the above resolution was duly adopted:
