ORDINANCE NO. OF 2022-12

AN ORDINANCE TO AMEND AND REENACT SECTION 11-5026.2 (a) (b)
CURFEW REGULATIONS FOR MINORS

BE IT ORDAINED by the Mayor and Board of Aldermen of the City of Jeanerette, in regular session assembled,

That the Code of Ordinance of the City of Jeanerette, SEC. 11-5026.2. DAY-TIME CURFEW REGULATIONS FOR MINORS OF COMPULSORY SCHOOL AGE; PARENTAL DUTY IMPOSED; PENALTIES FOR VIOLATIONS are hereby AMENDED and REENACTED to read as follows, to wit:

(a) No child between the ages of five (5) and eighteen (18) years, inclusive, who has enrolled or is required to be enrolled in the Iberia Parish School System shall be at any place within Iberia Parish except in attendance at the middle or high school (between the hours of 7:30 a.m. and 2:30 p.m. or elementary school between the hours of 7:30 a.m. and 3:05 p.m.) during any school day as defined by the Iberia Parish School Board unless that child has been suspended or expelled from school, in which case that child shall be required to remain in his domicile or place designated as his family home between the hours of 7:30 a.m. and 2:30 p.m., or the child has written proof from school authorities excusing him or her from attending school at that particular time, or unless the child is accompanied by a parent or legal guardian or other responsible adult selected by the parent or legal guardian to supervise the child.

(b) Each parent or legal guardian or other adult selected by the parent or legal guardian to supervise a child between the ages of five (5) and eighteen (18) years, inclusive, shall have a duty to prohibit the child from behaving contrary to the provisions in paragraph (a) of this section. No parent or legal guardian or other adult selected by the parent or legal guardian to supervise the child shall negligently or intentionally fail to fulfill the duty imposed in this section.

BE IT FURTHER ORDAINED, that all ordinances and resolutions in conflict herewith are hereby repealed.

This Ordinance shall take effect and be in force immediately after its adoption.

This Ordinance was introduced on the 12th day of December 2022 by Alderwoman Moore and second by Alderman Clark notice of public hearing having been posted on December 13, 2022, said public hearing having been held on January 9th, 2023 the title having been read and the ordinance considered, on motion of Alderman Clark whom moved its adoption, seconded by Alderwoman Moore and upon roll call was adopted by its title, section by section, and as a whole, by the following yea and nay vote:

Yeas: Alderman Clark, Alderwoman Moore, Alderman Bourgeois, Alderman Duplechain, Alderman Ward
Nay: None
Absent: None
Abstain: None
Motion Carried:

This Ordinance was thereupon declared adopted by Mayor and was approved and signed by him and attested by the City Clerk and the corporate seal of the City of Jeanerette affixed hereto on this 10th day of January 2023.
