ORDINANCE NO. 2022-01

AN ORDINANCE OF THE CITY OF JEANERETTE TO SELL BY SEALED-BID, CERTAIN ADJUDICATED PROPERTIES ACQUIRED BY THE CITY OF JEANERETTE

BE IT ORDAINED by the Board of Aldermen, City of Jeanerette, that:

WHEREAS, Jeanerette Board of Aldermen adopted Ordinance No. 2019-10A on December 23, 2019, finding that the sale of adjudicated property is in the best interests of the City of Jeanerette, both for housing and economic redevelopment purposes. Further, the Jeanerette Board of Aldermen found that accumulation of taxes, interest, penalties and other charges against adjudicated property are “blights” due to the depressive effect of under or unutilized properties on surrounding property values; and that adjudicated property is thus “blighted” as that term is used by the Constitution of Louisiana.

WHEREAS, the post-adjudication action complied with, Title 47, Subtitle III, Chapter 5, Part IV, Subpart B, La. R.S. 47:2201 et seq.; and gave effect to constitutional provisions, at LSA-Const. Art. VII, Sec. 14 (B), thereby permitting waiver of public charges against blighted properties.

WHEREAS, pursuant to La. R.S. 47:2201 et seq., LSA-Const. Art. VII, Sec. 14, City of Jeanerette declared by Ordinance No. 2021-06B, that it acquired full ownership of the below identified adjudicated property to the extent allowed by, and for the purposes allowed by, the Louisiana Constitution and La. R.S. 47:2201 et seq.

WHEREAS, it is the opinion of the Jeanerette Board of Aldermen that the below identified adjudicated property is not needed for public purposes; and pursuant to La. R.S. 33:4712, shall be sold to the highest bidder, through sealed bid beginning March 28th 2022 at 8:30 am and ending April 1st, 2022 at noon, with payment due from the highest bidder within 10 days or else the property will be offered to the next highest bidder.

WHEREAS, following the completion of the bidding process Mayor, Carol Bourgeois, Jr. shall have the authority on behalf of the City of Jeanerette to execute the conveyance of said property to the highest bidder, for an amount not less than the minimum prices established below.

NOW, THEREFORE, BE IT FURTHER ORDAINED by the Jeanerette Board of Alderman that:

SECTION 1: All of the aforedescribed "Whereas" clauses are adopted as part of this ordinance.

SECTION 2: The Jeanerette Board of Aldermen in due, regular and legal session convened does hereby declare its intension to sell, by sealed bid beginning March 28th 2022 at 8:30 am and ending April 1st, 2022 at noon, the following described properties by Cash Sale, for no less than the minimum price indicated:

SECTION 3: Following the effective date of this ordinance, notice of the proposed sales and bidding process shall be published once at least fifteen days prior to the date of the beginning of the bidding process in the official journal of the City of Jeanerette.

SECTION 5: All ordinances or resolutions, or parts thereof, in conflict herewith are hereby repealed.

SECTION 6: This ordinance shall become effective upon signature of the Mayor of Jeanerette, the elapse of ten (10) days after receipt by the Mayor of Jeanerette without signature or veto, or upon an override of a veto, whichever occurs first.

This Ordinance shall take effect on March 14th, 2022.

This Ordinance was introduced on the 14th day of February 2022 by Alderman Lancon, seconded by Alderman Bourgeois notice of public hearing having been posted on February 15th, 2022, said public hearing having been held on March 14, 2022, the title having been read and the ordinance considered, on motion of Alderman Lancon, whom moved its adoption, seconded by Alderman Lancon, and upon roll call was adopted by its title, section by section, and as a whole, by the following yea and nay vote:

YEAS: Alderman Lancon, Alderman Bourgeois, Alderwoman Moore, and Alderman Clark
NAYS: None
ABSENT: Alderman Ward

This Ordinance was thereupon declared adopted by Mayor and was approved and signed by him and attested by the City Clerk and the corporate seal of the City of Jeanerette affixed hereto on this 14th day of March, 2022.
