MEETING-BOARD OF ALDERMEN Monday, June 10, 2019

Proceedings of the Mayor and Board of Aldermen of the City of Jeanerette, State of Louisiana, taken at regular meeting held Monday June 10, 2019, at 6:30 p.m. The Mayor and Board of Aldermen met in regular session at their meeting place, City Hall, Jeanerette, Louisiana.

Those present were: Mayor Aprill Foulcard; Alderwoman Christia Simmons and Aldermen Kenneth Kern, Butch Bourgeois, Charles Williams, Sr., and Clarence Clark,

Also present were: Financial Administrator David Greer, City Attorney Roger Hamilton, and City Clerk Susan Colden, Treasurer Catherine Roy
Absent: None
Alderman Bourgeois led in prayer, and Alderman Williams led the Pledge of Allegiance. Mayor Foulcard determined that a quorum was present.
Alderman Clark moved and Alderwoman Williams seconded to expand the agenda to include item 7 C. 4, Fire Department Update
Alderman Williams moved and Alderwoman Simmons seconded to approve the Regular Meeting board minutes of the Last Regular meeting on May 14, 2019 meeting with all necessary corrections. Motion carried.
There was no correspondence
Announcements by the Mayor:
The TECHE project floating Dock Grant is moving forward and the engineering firm will be coming with Ms. Holland to Jeanerette on June 11 to visit the side and develop the specifications for the bid.
Report from the Wednesday June 5, 2019 City of Jeanerette Finance Committee Meeting
Present-Mayor Aprill Foulcard, Alderwoman Tia Simmons, Mayor-Elect Carol Bourgeois Jr., Calvin Bodin, Aldermen elect Louis Lancon, Mr. David Greer, and City Clerk Susan Colden
The May LAMP Overview and Sales Tax receipts, and P & L statements were reviewed. Sales tax is up slightly, most total expenses at or near projected levels. There was discussion on the distribution of sales tax from the Parish and the Park and Recreation Board. There was discussion on the use of drainage funds. With no other issues to discuss the meeting was adjourned.
Other Reports
Update from Fiscal Administrator Mr. David Greer-Louisiana Rural Water was in to conduct a Sewer rate study due to the sewer rehab grant, they determined that our rates are acceptable. Still working on issues related to water operation, still waiting to get tower cleaned, resolving chlorination issues some issues with a softener pump have been corrected. Work on the emergency repairs to the Canal street lift station have started. In the next five months the plan for the remaining lift station repairs should be ready for bids. We are addressing issues with the prior sewer compliance order.
Update from Neil Swain of Statewide Electrical Services on Sewer Operations- May was brought a lot of rain but there was not any damage to the pumps but with heavy rain there is infiltration in the system and the current pumps work hard to keep up, but the system is working. Mayor Foulcard asked about the switches that click off, Mr. Swain replied to prevent that we need to install lightening arrestors, Mr. Swain is making a list and hopes to have it a part of upgrades. Mr. Williams asked about the pump station on St. Nicholas, which is a diesel bypass pump. Mr. Swain explained the function and stated that there are plans to replace it with an electric pump which will reduce noise and hoses. This station is scheduled for upgrade.
Update on Bulk Waste Procedures by Dustin Fortenberry of Waste Connections. They haven’t set a date yet but it will be twice a month, an assessment needs to be done to see if the entire town in one month. What will be picked up will be everything that can normally be put in the garbage can, nothing hazardous, no fire hazards, no appliances. Anything that is generated by a professional service is not accepted, for example if a resident cleans out their flower beds the debris can be put out. If a professional service is hired to plant and clean then they have to remove their own waste, same with remodeling. The debris needs to be placed on the named road where the normal trashed is picked up and not in the ditches. Chief Landry then recognized Tyus Gage and promoted him to Lieutenant.
Update on Fire Operations by Chief Sherry Landry. Sherry reviewed the calls for the month of May and they are preparing for the insurance rating and have been working with the parish to secure a second truck.

Resolution 7 of 2019 Intergovernmental Agreement with St Mary Parish Water and Sewer Commission to collect the sewer service fee for residences the City of Jeanerette provides only sewer service.

ORDINANCE NO. 04 of 2019

AN ORDINANCE TO AMEND AND REENACT PART 8 HEALTH AND SANITATION, CHAPTER 1, SECTION 8-1010(b)(1)—MONTHLY CHARGES FOR SOLID WASTE COLLECTION AND DISPOSAL

BE IT ORDAINED by the Mayor and Board of Aldermen of the City of Jeanerette, in regular session assembled,

That the Code of Ordinance of the City of Jeanerette, Section 8-1010(b)(1) is hereby AMENDED and REENACTED to read as follows, to wit:

WHEREAS, the City of Jeanerette has been incurring expenses exceeding the collections for garbage from monthly charges for solid waste collection and disposal.

WHEREAS, the city has used its own personnel and equipment to collect and dispose of bulk waste in the city but has not charged customers for this service.

WHEREAS, the current garbage service operator can provide bulk waste pickup in a more economical and efficient manner than the city can provide.

WHEREAS, the Board of Alderman seeks to acknowledge the change in collection of bulk waste to be included as part of the services provided by Waste Connections.

BE IT THEREFORE ORDAINED, by the Board of Aldermen, City of Jeanerette, State of Louisiana that the ordinance now read

(b) Charges. There is hereby levied a service charge to defray the expense of the collection and disposal of solid waste, including garbage, trash, and other refuse, and to defray the expenses of maintenance of the general cleanliness and sanitation of the city, to be assessed and collected monthly on solid waste collections made by the city or its authorized representatives as follows:

(1) Regular service unit: Upon each owner, occupant or proprietor of a regular service unit as defined hereabove sixteen dollars and fifty cents ($16.50), and allot for increase or decrease when necessary due to the consumer price index (CPI).

BE IT FURTHER ORDAINED, by the Board of Aldermen, City of Jeanerette, State of Louisiana that David K. Greer, Court-Appointed Fiscal Administrator is hereby authorized to enter into an agreement with Waste Connections to modify current service to include bulk waste pick-up.

BE IT FURTHER ORDAINED, that all ordinances and resolutions in conflict herewith are hereby repealed.

This Ordinance shall take effect and be in force immediately after its adoption.

This Ordinance was introduced on the 14th day of May 2019 by Mr. David Greer with notice of public hearing to be held on June 10, 2019, the title having been read and the ordinance considered, on motion of Clark, whom moved its adoption, seconded by Williams, and upon roll call was adopted by its title, section by section, and as a whole, by the following yea and nay vote:

This Ordinance was thereupon declared adopted by Mayor and was approved and signed by her and attested by the City Clerk and the corporate seal of the City of Jeanerette affixed hereto on this 10th day of June, 2019.

Adopt Ordinance 2019-05 to Adopt Budget for Fiscal Year 2019-2020. Motion by Alderman Clark and Alderman Williams seconded to enter into public hearing, motion carried, after no questions or discussions motion by Alderman Williams and second by Alderwoman Simmons to leave public hearing and return to regular session, motion carried. Motion to adopt Ordinance 2019-05 to Adopt Budget for Fiscal Year 2019-2020 by Alderman Clark and second by Alderman Kern. Alderwoman Simmons stated “due to my conflict with Jeanerette City Court being a part of the budget for the City of Jeanerette, I hereby advise the council that I am recusing myself from voting pursuant to RS:42:1120. However I am allowed to discuss the budgets.”
