MINUTES REGULAR MEETING-BOARD OF ALDERMEN Monday July 11, 2022
Proceedings of the Mayor and Board of Aldermen of the City of Jeanerette, State of Louisiana, at their regular meeting held Monday July 11, 2022 at 6:30 p.m.
Those present were: Mayor Carol Bourgeois Jr., Alderman Clarence Clark, Alderwoman Charlene Moore, Alderman Garland Bourgeois, Alderman Willie Ward and Alderman Louis Lancon, Also present: City Clerk Susan Colden, and City Attorney Lucretia Pecantte. Treasurer Liz Verdun and Police Chief Vallot.
Mayor Carol Bourgeois Jr led in prayer and Alderman Ward led the Pledge of Allegiance. Mayor Carol Bourgeois Jr. determined that a quorum was present.
Motion by Alderman Lancon and second by Alderman Ward to expand the agenda to add item 9B approval of PPE #2 for Project 8227-15 Sewer System Rehabilitation Roll call vote

Motion Carried
5. Alderman Bourgeois moved and Alderwoman Moore seconded to approve Minutes of the Last Regular Meeting on June 13th, 2022 with all necessary corrections, Alderwoman Moore stated she voted no to the introduction of Ordinance 2022-06A and the City Clerk will change the record. Motion carried by voice vote of all yea, no abstain and no absent.
Alderman Clark moved and Alderwoman Moore seconded to approve Minutes of the Special Meeting on June 21th, 2022 with all necessary corrections. Motion carried by voice vote of all yea, no abstain and no absent.
6. Correspondence and item 7. Announcements by Mayor, Mayor outlined the meetings and efforts that occurred to help residents find the produce and meats for residents and how Raintree did offer to provide transportation to their store. The president of First National Bank of Jeanerette came in and said there is a new CDIF grant program that would allow residents who qualify to purchase homes with the down payment included in the financing at an affordable rate. Also Mr. Charlie Westley is looking to work with a strong, lightweight material to build homes possibly in our area. The City engineer, Gene Sellers provided an update on the sewer project and some upcoming grants. The Mayor said he is working to solicit a proclamation form the governor’s office to retain the title of City of Jeanerette. The water tower project has some delays but should be moving forward soon. The City is also in a position to possibly obtain a 5 million dollar grant for our sewer plant to finish renovations and construct a retention pond.
8A. Report from the Tuesday, July 5, 2022 City of Jeanerette Finance Committee Meeting Present - Mayor Carol Bourgeois Jr., City Clerk Susan Colden, Alderwoman Charlene Moore and Treasurer Liz Verdun. The Sales Tax revenue is higher than last year but we are expecting to see the effects of Mac’s and Dickies closing next month. Utility payments are on par with a total of 2003 customers and 63 customers are now using bank draft to pay. Bank balances are good but the Cash Flow Projections need to be updated to reflect the new budget. The payables are inline. The P & L has not had the requested changes completed yet by the accountants. The Sales of the property on 827 Morris Charles closed on June 27th. The bid for the property on 1715 Peach Street was withdrawn by Ms. Johnson. The committee discussed rebidding the properties at a lower price and will get information from Standard Title. The committee also discussed holding another surplus items sale. The committee was informed that the FEMA reimbursement for hurricane Delta was received. The group discussed a letter from Judge LeGros concerning challenges housing juvenile offenders. With no other business to consider, the meeting was adjourned.
8B. Report from the Tuesday July 5, 2022 Policy and Personnel Committee Meeting Present- Susan Colden City Clerk, Mayor Carol Bourgeois Jr., and Alderwoman Charlene Moore, Alderman Clarence Clark and Treasurer Liz Verdun. Alderman Clark reviewed a two Ordinances, one for Section 4-2002-2004 Fire Protection to make the personnel references more gender neutral. The second is to section 5-1023, Regulations for excavation, and the precautions that the City might wish to amend to this ordinance. The group decided to look at practices in other cities for ideas. After a brief discussion on various updates, the meeting was adjourned.
8C. Report from the Tuesday, July 5, 2022 City of Jeanerette Public Works and Safety Committee Meeting Present- Mayor Carol Bourgeois Jr., Alderman Butch Bourgeois, City Clerk Susan Colden, Fire Chief Sherry Landry, Chief Dusty Vallot, Public Works Director Howard White Public Works Supervisor Wade Tillman and Treasurer Liz Verdun, absent Willie “Poochie” Ward. Chief Landry reported in June there were 77 calls, 68 in the city and 9 auto aid. There was 2 structure fires in the City and auto aide for an RV and Commercial Building. On June 7th the new SCBA’s were put into service and were used a week later. The Chief also reported that on June 23rd they attended a LSU class hosted by St. Mary D11, and on the 28th they attended a summer camp at West St. Mary Civic Center and helped teach fire prevention. Chief Vallot reported the hire of 2 new part-time dispatchers. He also reported 266 incidents with 12 misdemeanor arrests, 5 felony arrests, 22 citations, 7 criminal summons, 5 cash bond, for a robbery there was an arrest of 3 juvenile and one adult, There was a discussion concerning which direction Flory Street should go. Chief Landry said for the fire trucks the best option is from Bracy to Pellerin and the group agreed. The Mayor outlined the efforts between the City and Parish to improve the drainage behind the Katherine Street properties. Supervisor Tillman reported that Public Works was called out for the fire at 1319 Main and for a tree that fell in the road. The department responded to 21 Dottie Markings, 13 sewer backups, cut grass, filled potholes, installed new stop signs on 3 streets, sprayed the tracks with herbicides and repaired 5 water leaks. There was a discussion on identifying items for the next surplus sale. With no other business to consider the meeting was adjourned. Mayor Bourgeois Jr. reviewed the efforts to have the Parish provide assistance to the drainage project on west side of town, of Trappey and Katherine streets.
8D. Report from Statewide Electric Sewer and Water Operations by Neal Swain, Mr. Swain reported on June 26, weather, possibly lightening affected King Joseph and Main Station. All the soft starts at Main Station shorted out and they were able to get the backup systems to work. They cost about $1,500 each. That same night the breaker and the motor starter at King Joseph burnt. There has been a lot of work performed at the sewer plant. The headworks has been bypassed and both of the clarifiers are online. And they are waiting for the engineer and the contractor to come up with a plan for the aerators. There was a general discussion on upcoming projects and infiltration issues. On the water side hopefully we will be able to replace the valve at the water plant tomorrow. The work will be done overnight and should take no more then 5 hours. Molly resigned due to a medical issue for her husband.

Approval of Pay Estimate No. 4 (Final) for approval. This is for 8002-09 Hubertville Road Water Main Railroad Crossing
Motion by Alderman Ward second by Alderman Lancon to approve, motion carried by voice vote of all yea, no abstain and no absent.
B: Approval of PPE #2 for Project 8227-15 Sewer System Rehabilitation. Motion by Alderman Bourgeois Second by Alderman
Motion by Alderman Bourgeois second by Alderman Clark to approve, motion carried by voice vote of all yea, no abstain and no absent.
12 A. Adopt Ordinance 2022-06A An ordinance modifying the role of Mayor Pro Tempe (Alderman Clark) motion by Alderman Bourgeois and second by Alderman Lancon to leave regular session and go to public session, with a voice vote of all yea, no abstain and no absent. Alderman Clark reviewed the Ordinance that he is bringing forth. Mayor Bourgeois Jr. deferred his comments to City Attorney Lucretia Pecantte. Ms Pecantte stated that this Ordinance is an expansion of the powers of the Mayor Pro Tempe. Alderman Clark questioned Ms. Pecantte regarding her statement and then Alderwoman Moore stated that this Ordinance came about because Alderman Lancon signed a grant document as a member of the finance committee and she thought Alderman Clark was not acting correctly. It was asked by the public what powers are being expanded and Attorney Pecantte reviewed. After a lively discussion. Alderman Lancon stated he signed a document, after the council had approved the grant application, and the document attested that the Mayor was authorized to sign the documents. After a lively discussion the Mayor stated that the State mandates the Mayor signs all the documents. After a few more questions motion by Alderman Lancon and second by Alderwoman Moore to leave public session and return to regular session motion carried with a voice vote of all yeah. Motion by Alderman Lancon and second by Alderman Ward to table the Ordinance Roll call

B. Adopt Ordinance 2022-06B to Amend and Reenact sections 4-1003, 4-1004 and 4-1008 Police Protection (Alderman Clark) to specify hierarchy of reporting for law officer. A motion by Alderman Lancon and second by Alderman Clark to Amend section 4-1003 to read “Subject to the supervision of the Mayor the chief of police shall”, carried with a voice vote of all yea, no abstain and no absent. Motion to leave regular session and enter public hearing by Alderman Lancon and second by Alderman Clark carried with a voice vote of all yea, no abstain and no absent. Introduction by Alderman Clark and a discussion between Alderman Clark and Alderman Ward regarding the chain of command in surrounding communities. Officer Ligon questioned the reporting structure and requested clarification. There was a discussion among the Board and Mayor regarding the chain of command and the wording of the Ordinance. There was a discussion regarding drug screens and lack of rank structure. On Motion by Alderman Lancon, second by Alderman Clark to leave public session and return to regular session carried with a voice vote of all yea, no abstain and no absent. Motion to adopt Ordinance 2022-06B to Amend and Reenact sections 4-1003, 4-1004 and 4-1008 by Alderman Clark and second by Alderman Lancon.

Mayor Carol Bourgeois Jr. informed the Board of Aldermen that he will consider vetoing this Ordinance and will create a written response within the 10 day period
C. Introduce Ordinance 2022-07A An Ordinance to change Flory to a One-Way Street (Alderman Bourgeois) Introduction by Alderman Bourgeois that this Ordinance stemmed from requests from the residents and input from the Police and Fire Chief to route the traffic one way from Bracy to Pellerin. The Ordinance was introduced by motion by Alderman Lancon and second by Alderwoman Moore and motion carried with a voice vote of all yea, no nay and no abstain.
D. Introduce Ordinance 2022-07B An Ordinance to Amend and Reenact Sections 4-2002, 4-2003, 4-2004 Fire Protection (Alderman Clark) Into On motion by Alderman Clark second by Alderman Lancon motion carried with a voice vote of all yeah, no nay and no abstain.
Alderman Lancon announced he will be resigning from the Board effective July 31, 2022 due to changes in his residency.
Motion to leave regular session and enter executive session on motion by Alderman Bourgeois and second by Alderwoman Moore passed with a voice vote of all yea no nay and no abstain.
13. Executive Session Darrell Wayne Green V Tyler Dauphinet (16th Judicial # 00138371)
Motion to leave executive session and return to regular session by motion of Alderman Bourgeois, second by Alderwoman Moore and passed by a voice vote of all yea, no nay and no abstain.
Adjourn There being no further business to bring before the Board of Aldermen a motion by Alderman Bourgeois and second by Alderman Lancon to adjourn the meeting carried with a voice vote of all yea, no abstain and no absent.
